General Terms and Conditions (GTC) - "Haus Estrelicia"

  1. Arrival / departure

Saturday from 4 p.m. until the following Saturday at 10 a.m. at the latest. The arrival and departure times also apply to individually agreed weekdays. The departure must take place on the day of departure by 10 a.m. at the latest to ensure cleaning before the new occupancy. If the departure time is exceeded by more than 60 minutes, an additional night will be charged. Other arrival and departure times can be agreed individually with the landlord. If the tenant does not appear on the day of arrival by 10 p.m., the contract is deemed to have been terminated after a period of 48 hours without notification to the landlord. The landlord or his representative can then freely dispose of the property. A (partial) repayment of the rent due to early departure will not be made.

 

  1. Special requests and side agreements

are basically possible. They require written confirmation by the landlord. It is forbidden to house pets. As an exception and on special request, the type and size must already be specified in the booking request. The acquiescence is only possible upon presentation of a liability insurance confirmation and is only granted in writing.

 

  1. pay

The rental contract becomes valid when the deposit is received in the landlord's account. The down payment of 20% of the rental amount is due for payment within seven days of receipt of the booking documents. After the deposit has been made, the remaining amount and the deposit of € 1000 are due 30 days before the start of the journey. The deposit can be reduced to € 500, provided written confirmation of a valid liability insurance for the tenant is presented.

 

If the payment deadlines are not met, the landlord can withdraw from the contract. Failure to pay the deposit / final payment is considered a resignation and entitles you to re-let.

 

Additional costs for water, gas, electricity and waste are not charged. The consumption costs for water, gas and electricity in Portugal are high. Environmentally friendly handling is essential.

Gas, water and energy costs for heating and cooling are not billed additionally for standard consumption (average consumption for the same user group and season). However, the landlord reserves the right to issue a separate invoice in the event of disproportionate use of gas, water and electricity and to withhold the amount directly from the rental deposit. The meter readings are recorded regularly for this purpose.

 

  1. resignation

You can withdraw from the contract. The withdrawal must be made in writing. In the event of withdrawal, you are obliged to compensate us for the damage incurred:

 

• No compensation from the day of the booking confirmation by the landlord until the 121st day before the start of the rental period

• From the 120th day to the 61st day before the start of the rental period, the amount of the deposit

• from the 60th day to the 15th day before the start of the rental period, 50% of the total price

• from the 14th day to the 8th day before the start of the rental period, 80% of the total price

If the cancellation is made less than eight days before the start of the rental period, the full travel price must be paid.

The date of receipt of your cancellation message counts. Amounts already paid will be offset. You can provide a replacement person who enters into your contract under the conditions mentioned. Written notification and confirmation are required.

 

If there are disruptions in performance due to official instructions in Portugal (e.g. Corona shutdown) or force majeure, mutual claims for damages are largely excluded. In this case, the individual examination is required.

 

  1. Tenant's Obligations

The tenant undertakes to treat the rented items (holiday home, inventory and outdoor facilities) with care.

Supplies can be used and replenished with equivalent replacements.

If damage occurs to the holiday home and / or its inventory during the tenancy, the tenant is obliged to notify the property management immediately. Defects and damage already discovered on arrival must be reported to the property management immediately, otherwise the tenant is liable for this damage. A reasonable period must be allowed for the elimination of damage and defects. Claims based on complaints that are not reported immediately on site are excluded. Complaints received by the landlord at the end of the stay or after leaving the holiday home are also excluded from compensation. In the event of any disruptions in performance, the tenant is obliged to do everything reasonable within the scope of his legal obligation to help remedy the disruption and to keep any damage that may have occurred to a minimum. On the day of departure, the renter must remove personal items, dispose of household waste in the designated containers, and store dishes clean and washed in the kitchen cupboards.

 

  1. privacy

The tenant agrees that necessary personal data will be stored, changed and / or deleted as part of the contract concluded with him. All personal data are provided voluntarily and treated with absolute confidentiality. (See privacy policy)

 

  1. liability

The tender was drawn up to the best of our knowledge. We are not liable for any influence on the rental property through force majeure, customary power and water failures and storms. Likewise, there is no liability in the event of unforeseeable or unavoidable circumstances such as official orders, sudden construction sites or for disturbances due to natural and local conditions. The landlord is happy to help you solve the problems (as far as possible). Liability on the part of the lessor for the use of the play and sports equipment provided is excluded. The arrival and departure of the tenant is at their own responsibility and liability. The landlord is not liable for personal items in the event of theft or fire. The tenant is fully liable for willful destruction or damage.

 

  1. Final provisions

Photos and text on the website or in the flyer serve as a realistic description. A 100 percent match with the rental property cannot be guaranteed. The landlord reserves the right to change the equipment (e.g. furniture) provided they are equivalent. Should one or more provisions of these terms and conditions be or become ineffective, this does not affect the effectiveness of the remaining conditions. The ineffective regulation is to be replaced by an effective one that comes close to the economic and legal will of the contracting parties. German law applies. The place of jurisdiction and fulfillment is the landlord's place of residence.
